The contract between you and BC Gems Company

We must receive payment in whole for the price of the goods that you order, before your order can be accepted and dispatched.

Our acceptance of your order(s) brings into existence a legally binding contract between us. Only persons aged 18 and over may enter into legally binding contracts and as a result are the only people entitled to transact through this website’s shop.

Pricing of merchandise

• We reserve the right to amend prices without prior notification.

Transactions and Cancellations

• We will deliver the goods ordered by you to the address you provided. It is your responsibility to ensure that the delivery address you provide is correct.
• All orders are delivered using Canada Post Services.
• You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you, they will be held at your own risk and we will not be liable for their loss or destruction.
• If your order is returned to us because the courier could not complete the delivery to you, you will be responsible for the repeat delivery costs.
• Your package should arrive within 1-2 weeks (Domestic and International) from the day you ordered. In the event of a postal services interruption, we will notify you so that you may choose to
  1.1 Wait for re-commencement of the courier service or
  1.2 Opt for the alternative method by us (may cost additional shipping).
• We reserve the right to cancel the order between you and us if we have insufficient stock to deliver the goods you have ordered.
• We will cancel an order if the goods have not yet been dispatched and you placed a request to terminate the transaction. We will ship the goods to your provided address within 1-3 business days, excluding holidays.
• In the event of a successful cancellation, we will notify you and your account will be credited the full amount deducted by us.
• Currency exchange rates change regularly and is out of our control, so the amount you see credited back to your credit card may be slightly different to your original payment amount.

Liability

• If you receive goods that are damaged or defective or of an incorrect quantity, notify us by e-mail of the issue within seven (7) days of the delivery of the goods in question and we will try to resolve the issue in a reasonably timely manner.
• We cannot be held responsible for any delays once the goods have left us and are in possession of the courier mail services.
• In the event you return an item to us, you will receive a full refund of the item. The shipping cost is non-refundable. The shipping cost is deducted from refunds. Return shipping is your responsibility and is non-refundable.
• We cannot be held accountable for any misrepresented third-party information such as discounted offers and sales.

Invalidity

• If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Governing Law

• Each and every transaction carried out is deemed to be completed within Canada and therefore shall be governed by and interpreted in accordance with Canadian Law. The terms of any dispute, controversy, proceedings or claims (of whatever nature in relation to them) shall be governed and interpreted in accordance with Canadian Law.
